Annex D (recommended) Documentation of the historic settlement
Corresponds to Russian Annex Г.
This Annex contains recommendations on the development of the scientific and design documentation of a historic settlement in conjunction with the development and implementation of sustainable development documentation carried out under Clauses 4–12 of this standard. The recommendations relate to the historical and cultural reference plan, the boundaries of the territory, the subject of protection, the list of historically valuable town-forming objects and the requirements for urban-planning regulations. Sustainable development documentation does not establish mandatory conditions for the approval of the boundaries of the territory, of the subject of protection, of the protection regimes or of the requirements for urban-planning regulations. The procedure for including an inhabited locality in the list of historic settlements of federal significance and for approving the subject of protection, the boundaries of the territory and the requirements for urban-planning regulations is established by Order of the Ministry of Culture of the Russian Federation No. 1604 of 12 July 2016 [7]. The requirements for determining the boundaries of the territory of a historic settlement are established by Resolution of the Government of the Russian Federation No. 1095 of 28 November 2013 [8]. This Annex and the sustainable development documentation do not replace those acts. The procedure of approval is set by those acts, and not by this standard.
D.1 Purpose
D.1.1 This Annex is applied in the development and updating of the documentation of a historic settlement and in the formation of the technical assignment for such development. It is recommended that the Annex be applied together with the development of sustainable development documentation and taken into account in its implementation (Clauses 10–12). Joint development is the recommended mode. The procedure of approval is not established by this Annex (D.1.4).
D.1.2 The Annex determines:
a) the recommended mode of linking the documentation of the historic settlement with the development and implementation of sustainable development documentation;
b) the principles of development of the documentation of the historic settlement, and not of documentation on a single object;
c) the recommended composition of the scientific and design documentation and the content of its substantive parts;
d) recommendations for the historical and cultural reference plan, the boundaries of the territory, the subject of protection and the requirements for urban-planning regulations;
e) the recommended procedure for the development and application of the documentation of the historic settlement.
The provisions of this Annex are recommendatory and are not requirements for the establishment of protection regimes or of requirements for urban-planning regulations.
D.1.3 The documentation of the historic settlement and the sustainable development documentation form two related but not identical systems of documents. The link "state protection — sustainable development" is applied throughout the cycle of Clauses 4–12, and not only at the stage of studies.
The documentation of the historic settlement secures the state protection of the historic settlement in accordance with Articles 59 and 60 of Federal Law No. 73-FZ [1]. It includes the materials of historical and architectural, historical and urban-planning and archival studies; where they exist, information from previously completed archaeological studies; a draft of the boundaries of the territory; a draft of the subject of protection; a draft of the requirements for urban-planning regulations; the historical and cultural reference plan; the list of historically valuable town-forming objects. A separate archaeological study is not carried out when the documentation of the historic settlement is formed.
Sustainable development documentation secures the analysis of the state of the territory of the historic settlement, of the problems and directions of its sustainable development, and the determination and implementation of the list of measures for the sustainable development of the territory of the historic settlement provided for by subparagraphs 1 and 2 of paragraph 3 of Article 60 of Federal Law No. 73-FZ [1], and is developed under Clauses 4–12 of this standard. Sustainable development documentation does not replace the acts of state protection of the historic settlement and does not make their approval conditional.
D.1.4 The documentation of the historic settlement is not subject to the state historical and cultural expert review. The assessment under 7.12.1 and 7.12.2 is applied to options for the boundaries and for the requirements for urban-planning regulations (D.2.6) as an instrument of analysis of the sustainable development documentation. The assessment is not the state historical and cultural expert review (4.3.6) and is not a condition of approval of the documentation of the historic settlement in the established procedure. This Annex does not establish a mandatory administrative procedure for the approval of the documentation of the historic settlement.
D.2 Link with the development and implementation of sustainable development documentation
D.2.1 The degree of formalization of the status of the historic settlement is determined by the presence or absence of approved boundaries of the territory, of an approved subject of protection and of established requirements for urban-planning regulations (5.1.2). The depth of objective-setting of the sustainable development documentation and the concreteness of the constraints taken into account in the development of the territory depend on the degree of formalization.
D.2.2 Where formalization of the status is insufficient, it is recommended that the filling of the gaps be included among the objectives of the sustainable development documentation (5.1.2, 5.8.3). It is recommended that the completion of formalization be carried out at the same time as the formation of development programmes and measures and as the check of the reality of the socio-economic model of the territory within the boundaries and constraints being established (4.1.3, 4.5.4). Simultaneity is a recommendation (D.1.1).
D.2.3 It is not recommended that the regulatory part of the documentation of the historic settlement run ahead of the economic model and of the development programmes that provide an understanding of the conditions of activity within the boundaries of the constraints. Approval of the boundaries and of the requirements for urban-planning regulations without a confirmed viability of the model of the territory is not recommended.
D.2.4 Sustainable development documentation recommends that the following verifiable conditions be taken into account in the development of the documentation of the historic settlement:
a) the boundaries of the territory of the historic settlement secure the integrity of the elements of the subject of protection and a sufficient size of the territory for the expression of historical and cultural value (3.1.9);
b) the system boundaries of the objective-setting of the sustainable development documentation may extend beyond the boundaries of the historic settlement where functional links with adjoining territories need to be taken into account (5.3.1); such links do not replace the boundaries of the historic settlement and are recorded separately;
c) the subject of protection records the elements to be preserved in legally precise language; beyond the subject of protection, continuous development is permitted (4.3.8);
d) the requirements for urban-planning regulations secure the conditions for preserving the elements of the subject of protection and do not establish constraints beyond those necessary for such preservation;
e) the requirements for urban-planning regulations are checked for compatibility with the load on historic territories (4.3.11) and for the risks of displacement of residents (5.2.6);
f) the historical and cultural reference plan is formed as a set of geographic information layers suitable for the information system of the territory (Annex C), and not only as a drawing attached to a legal act.
The conditions indicated are not requirements for the establishment of protection regimes or of requirements for urban-planning regulations and do not replace the grounds established by the legislation on cultural heritage objects.
D.2.5 The powers to identify, determine and record value characteristics and to regulate the development of the territory are separated (4.5.4). The subject of protection and the requirements necessary for its preservation are formed on the commission of the cultural heritage protection authority. The remainder of the urban-planning regulations and the approaches to the development of the territory are formed on the commission of the local self-government body. The combination of both roles in one design team without a separation of responsibility is not recommended: a weak subject of protection is not compensated by a tightening of the limit parameters of the regulations.
D.2.6 Before approval, it is recommended that options for the boundaries of the territory and for the requirements for urban-planning regulations be checked by the assessment of effects on the subject of protection (7.12.1) and by the additional impact assessment (7.12.2). An option that is incompatible with the subject of protection should be excluded or revised. The assessment is not a condition of approval (D.1.4).
D.2.7 After approval, the boundaries of the territory, the subject of protection and the requirements for urban-planning regulations are constraints on the development and implementation of sustainable development documentation. They are taken into account in the collection of source data (6.2.2), in the analysis (7.3.7, 7.4.6), in the project solution (9.5.4), in the implementation plan (Clause 10, 10.5), in the implementation management system (11.7) and in monitoring (Clause 12). This is the only direction of the link that is mandatory for sustainable development documentation. Sustainable development documentation does not replace those acts (D.1.3). Updating of the documentation of the historic settlement under D.9.6 is recommended on the basis of the results of monitoring and is not an automatic review of the act.
D.2.8 In mode A the approved boundaries of the territory, the subject of protection and the requirements for urban-planning regulations constrain the conceptual part of the master plan, the functional zoning, the placement of objects and the priority projects. Options for the boundaries and for the requirements before approval (D.2.6) should be considered at the same time as the draft master plan.
D.3 Principles of development of the documentation of the historic settlement
D.3.1 This subclause gives recommendations for the development of the documentation of the historic settlement in conjunction with sustainable development documentation. The documentation of the historic settlement may be developed outside the package of sustainable development documentation; this Annex recommends the link.
Heritage management is regarded as the management of change with the preservation of value (4.3.8). The elements to be preserved are strictly fixed within the subject of protection. In respect of the remainder, continuous development is permitted.
D.3.2 The historic settlement is considered within the notion of the "historic urban landscape": the result of the historic layering of cultural and natural values, extending beyond the notion of the "historic centre" (3.1.11, 4.3.4). Everyday landscapes and landscapes in need of restoration are taken into account (4.2.2).
D.3.3 The composition of the subject of protection of the historic settlement that is approved corresponds to paragraph 2 of Article 59 of Federal Law No. 73-FZ [1] and to 6.2.3. For the analysis of the territory, an analytical grouping by the layers of the historic urban landscape may additionally be used (3.1.11; Annex B, B.1.3):
a) the historic built fabric;
b) the planning structure;
c) natural elements and the landscape;
d) visual links.
The grouping indicated does not replace the six items of paragraph 2 of Article 59 of that Federal Law [1] and does not include intangible practices in the subject of protection. Intangible practices are inventoried under 6.2.5. An isolated description of individual layers without the recording of the links between them is not recommended.
D.3.4 Intangible cultural heritage is documented with the participation of communities. The area of occurrence, the places, routes and spaces, the bearers, the ways of transmission and the associated urban resources are recorded (6.2.5). Intangible heritage is not reduced exclusively to tourism. The intangible layer is described as a characteristic of the environment that is to be taken into account in regulation, and not as a prohibition of economic activity in itself and not as an element of the subject of protection that is approved.
D.3.5 The subject of protection is used as a basis for prioritizing development measures and for forming requirements for urban-planning regulations (4.3.3). Cultural value is taken into account on an equal footing with financial value. A points "cut-off" of the value of the settlement as the sole ground for inclusion in the list or for the removal of constraints is not applied. After approval, the subject of protection is used in the implementation of sustainable development documentation (10.5, 11.7).
D.3.6 New construction and reconstruction within the boundaries of the historic settlement are regarded as an inevitable part of the life of the inhabited locality. The permissibility of changes is determined by compatibility with the subject of protection, by the mitigation hierarchy (4.3.6) and by the quality of interventions (4.3.7), including in the implementation of the measures of sustainable development documentation. A prohibition of any new construction on the whole territory of the historic settlement is not an objective of the documentation.
D.3.7 Historically valuable town-forming objects that are not cultural heritage objects are included in the subject of protection. The requirements for urban-planning regulations establish the conditions of their preservation, reconstruction, repair, adaptation and, where there is a justified necessity, reconstruction of what has been lost. The absence of a special legal regime for such objects is not a ground for leaving them without regulation.
D.3.8 The documentation of the historic settlement is prepared in a machine-readable form, with georeferencing of the requirements for urban-planning regulations. The historical and cultural reference plan and the graphic descriptions of the boundaries, of the subject of protection and of the requirements for urban-planning regulations form a cartographic layer of the information system of the territory and supplement the graph model (Annex C). It is recommended that the layer be kept current at the stage of implementation of sustainable development documentation. The graph model does not replace the historical and cultural reference plan.
D.4 Composition of the scientific and design documentation
D.4.1 The recommended composition of the scientific and design documentation of the historic settlement includes the documents provided for by paragraph 3 of the Procedure approved by Order of the Ministry of Culture of the Russian Federation No. 1604 of 12 July 2016 [7]. In joint development with sustainable development documentation, it is recommended that the substantiating materials include materials useful for Clauses 4–12 of this standard, including a check of the socio-economic model and the assessment under 7.12.1 and 7.12.2. The package to be approved under that Procedure is not extended by those materials (D.1.4).
D.4.2 The principal composition of the documentation of the historic settlement is given in D.1.3. It is additionally recommended that the substantiating materials include materials of the check of the compatibility of the boundaries and constraints being established with the socio-economic model of the territory and with the load on historic territories (4.3.11). These materials are not subject to approval as part of the legal act establishing the boundaries, the subject of protection and the requirements for urban-planning regulations. The presence or absence of those materials is not a condition of approval (D.1.4).
D.4.3 The substantive parts of the documentation are distinguished regardless of the arrangement of the volumes. One substantive part may be presented in textual and graphic forms. Duplication of the same provisions in several volumes without a cross-reference is not recommended. In joint development, cross-references between the package of documentation of the historic settlement and the clauses of the sustainable development documentation are recommended. A reference to a clause of the sustainable development documentation does not give it the force of a protection act.
D.4.4 Substantive parts of the study materials:
a) a retrospective analysis of the stages of formation of the planning and the built fabric;
b) a historical and architectural analysis of the built fabric, ensembles, morphotypes and stylistic characteristics;
c) a historical and urban-planning analysis of the planning, compositional-spatial and scale structure;
d) a landscape and visual analysis of panoramas, visual openings, the silhouette and the points of perception;
e) information on the cultural layer; previously obtained archaeological information (D.1.3);
f) an inventory of cultural heritage objects, identified objects and historically valuable town-forming objects;
g) an inventory of lost and degraded elements of the historic environment;
h) an inventory of intangible practices and of the spatial conditions of their transmission;
i) an analysis of the layering of constraints in force: protection zones of cultural heritage objects, safeguard zones, urban-planning regulations.
D.4.5 The substantive parts of the package to be approved reproduce the structure of paragraph 2 of Article 59 of Federal Law No. 73-FZ [1] and are supplemented by the elements without which the documentation does not describe the historic settlement. The boundaries of the territory of the historic settlement are established within the corresponding inhabited locality: they may cover the inhabited locality as a whole or a part of it, be smaller than the city and not coincide with it. The composition of the substantive parts is given in Table D.1.
Table D.1 — Substantive parts of the documentation of the historic settlement
| Substantive part | Where it is recorded | Purpose |

D.4.6 The graphic part is carried out at a scale that secures the unambiguous identification of the elements of the subject of protection and of the turning points of the boundaries. For a compact historic settlement a scale of 1:2000 is recommended. For a large historic settlement a combination of overview schemes at 1:5000–1:10 000 and of fragments at 1:2000 may be used. The coordinates of the characteristic points of the boundaries are given in the local coordinate system used for maintaining the Unified state register of real estate.
D.4.7 It is recommended that the textual and graphic descriptions of one and the same entity be reconciled with each other. Where they diverge, the textual description of the legal act has priority, unless the act establishes otherwise. Contradictions are removed before the documentation is sent for approval.
D.5 Historical and cultural reference plan
D.5.1 The historical and cultural reference plan of the historic settlement (hereinafter the reference plan) reflects the preserved and lost elements that characterize the historical and cultural value of the territory, including cultural heritage objects, identified cultural heritage objects, objects that constitute the subject of protection, the boundaries of the territory of the historic settlement and the protection zones of cultural heritage objects.
D.5.2 The reference plan is a research and substantiating document. It precedes the draft boundaries, the draft subject of protection and the draft requirements for urban-planning regulations and serves as their common factual basis. The formation of the boundaries of sustainable development is carried out taking into account the information of the reference plan (5.3.1). In joint development, it is recommended that the information of the reference plan be used as source data of Clauses 6 and 7 of the sustainable development documentation. Sustainable development documentation does not replace the reference plan.
D.5.3 The reference plan is carried out as a set of layers. The layers may be combined on one drawing if legibility is preserved. The recommended composition of the layers is:
a) cultural heritage objects, identified objects, historically valuable town-forming objects;
b) preservation of the planning structure: the street network, blocks, squares, historic red lines and building lines;
c) the spatial-volumetric structure and the morphotypes of development, including development adapted to the historic environment and dissonant development;
d) the natural framework: relief, hydrography, planting, open spaces;
e) compositional and visual links: panoramas, views, points and sectors of perception, visual corridors;
f) lost buildings, dominants, fragments of planning and visual links;
g) information on the cultural layer; previously obtained archaeological information (D.1.3);
h) the boundaries of the territory of the historic settlement, the protection zones in force, the safeguard zones, the boundaries of the territories of cultural heritage objects;
i) the areas of intangible practices, the routes and the places of transmission of traditions;
j) zones of permissible continuous development of planning, of the built fabric, of planting and of the improvement of the public realm in connection with the loss of the value of the environment.
D.5.4 The textual part of the reference plan contains a historical and analytical note. Factual information is accompanied by references to sources. Hypotheses and the author's reconstructions are separated from established facts.
D.5.5 The reference plan is prepared as a geographic information data set. Each object of a layer has an identifier, value attributes, a condition, a date of recording and a spatial reference. The composition of the attributes provides for the filling of the graph of the current state of the urban system (Annex C) and for the calculation of the indicators of the condition of the elements of the subject of protection (Annex B). It is recommended that the layers of the reference plan be maintained in the information system of the territory at the stage of implementation of sustainable development documentation.
D.6 Boundaries of the territory of the historic settlement
D.6.1 The boundaries of the territory of the historic settlement are determined on the basis of the substantiating materials, including historical and architectural, historical and urban-planning and archival studies, in accordance with Resolution of the Government of the Russian Federation No. 1095 of 28 November 2013 [8]. Archaeological information is used only from previously completed studies (D.1.3).
D.6.2 The materials substantiating the boundaries contain:
a) the historical and cultural reference plan;
b) a description of the built fabric and the list of historically valuable town-forming objects;
c) a graphic analysis of the preservation of the planning structure and of its elements;
d) an analysis of the relationship of urban spaces;
e) a textual description of the boundaries, a list of the coordinates of the characteristic points and a graphic description.
D.6.3 The boundary is drawn along the contour within which the integrity of the elements of the subject of protection is preserved. The inclusion of territories that do not bear elements of the subject of protection and are not necessary for the perception and functioning of the historic environment is not recommended. The exclusion of territories necessary for the integrity of the planning structure, of the silhouette, of the panoramas or of the natural framework is not recommended.
D.6.4 The boundaries of the territory of the historic settlement are established within the corresponding inhabited locality (D.4.5). The boundaries may not coincide with the boundaries of cadastral blocks and of territorial zones. Coincidence with such boundaries is permitted if it is confirmed by a historical and cultural justification, and not by the convenience of the description.
D.6.5 The boundaries of the territory of the historic settlement are not identical to the scope of the sustainable development documentation. The scope may be wider than the boundaries of the historic settlement by reason of functional links and narrower by reason of the zones of authority (5.3). The boundary of the historic settlement and the scope are described separately. In the implementation of sustainable development documentation the boundary of the historic settlement is not replaced by the zones of authority. In mode A the territory of development is the territory of the master plan, and the territory of the historic settlement is a zone of special requirements within it (5.3.1).
D.6.6 The points and sectors of perception of the panoramas that constitute the subject of protection may be located outside the boundaries of the territory of the historic settlement. In that case the documentation records the location of the points, the sector of view and the requirements for the preservation of the view. Such requirements do not automatically extend the boundary of the historic settlement and are taken into account in the urban-planning regulations of the territorial zones within the boundaries of which the said points (sectors) are located (subparagraph 3.1 of paragraph 3 of Article 60 of Federal Law No. 73-FZ [1]).
D.6.7 Before the approval of the boundaries, a check is recommended: the socio-economic model of the territory within the proposed boundaries and constraints is realistic (5.3.3). If the model is not viable, it is recommended that the boundary, the set of constraints or the set of development measures be reviewed, and that unsecured requirements not be fixed. Refusal of the said check is not a ground for non-approval of the boundaries (D.1.3).
D.7 Subject of protection of the historic settlement
D.7.1 The subject of protection of the historic settlement is the aggregate of the characteristics subject to preservation. The core of the composition is established by paragraph 2 of Article 59 of Federal Law No. 73-FZ [1]:
a) historically valuable town-forming objects — buildings and structures that form the historic built fabric, including scale, volume, structure, style, structural materials, colour scheme and decorative elements;
b) the planning structure, including its elements;
c) the spatial-volumetric structure;
d) the composition and silhouette of the built fabric — the relationship of vertical and horizontal dominants and accents;
e) the relationship between different urban spaces (open, built-up, planted);
f) compositional and visual links (panoramas), and the relationship between the natural setting and the setting created by people.
D.7.2 The description of the subject of protection is carried out so that each element can be identified on the ground and on the reference plan. General formulations without an indication of specific characteristics, addresses, morphotypes, lines, elevations or sectors of perception should not be included in the part to be approved.
D.7.3 For the layer of the built fabric the following are indicated: typological characteristics, the number of storeys, materials, the character of the roof, the street frontage, the rhythm of openings, the colour scheme — to the extent necessary to distinguish what is to be preserved from what may be changed. A list of individual buildings without a typology of the environment is not sufficient.
D.7.4 For the planning structure the following are indicated: historic red lines and building lines, the configuration of blocks and squares, compositional axes, ascents, retaining walls, preserved elements of land survey. Sections that require restoration of the historic building line are recorded.
D.7.5 For the composition and the silhouette, the existing dominants and accents, the background built fabric and, where there is a justification, the lost dominants necessary for an understanding of the integrity of the silhouette are indicated. Inclusion of a lost element in the subject of protection means recognition of its significance for integrity, and not an automatic obligation of reconstruction. It is recommended that the decision on regeneration be taken taking into account the sustainable development documentation and with the assessment under 7.12 (4.3.12, 7.3.4). Sustainable development documentation is not a permission of the protection authority for regeneration.
D.7.6 For visual links the name of the view or panorama, the point or sector of perception, the composition of the elements viewed and the features subject to preservation are indicated. The points of perception are plotted on the graphic part.
D.7.7 Intangible practices are inventoried under 6.2.5 and belong to intangible heritage (3.1.10). They are not included in the subject of protection of the historic settlement that is approved (3.1.3). The description of the spatial conditions of the occurrence of the practices is recorded in the inventory materials and does not prescribe mandatory kinds of activity.
D.7.8 After approval, the subject of protection is a working constraint on the implementation of sustainable development documentation (10.5, 11.7).
D.8 Requirements for urban-planning regulations
D.8.1 The general principles for establishing requirements for urban-planning regulations within the boundaries of the territory of a historic settlement of federal significance are established by paragraph 4 of the Procedure approved by Order of the Ministry of Culture of the Russian Federation No. 1604 of 12 July 2016 [7]. This subclause gives recommendations on the content of those principles as applied to a historic settlement and to the link with the development and implementation of sustainable development documentation. Sustainable development documentation does not prescribe specific parameters of the requirements for urban-planning regulations and is not a ground for their establishment.
D.8.2 The requirements for urban-planning regulations include:
a) general provisions on the special regulation of urban-planning activity;
b) requirements for the types of permitted use of land plots: types necessary for the preservation of the historic settlement and subject to inclusion among the permitted types; types that cannot be included in the list of permitted types;
c) requirements for the limit parameters: the maximum number of storeys and the height from the existing ground level; the maximum percentage of development; the maximum length of the facade along the street frontage; the setback from the historic building lines;
d) requirements for additional parameters: the historic compositional-spatial type of development to be preserved or renewed; the length of the plot along the street; the minimum size of the intervals in the street frontage; the maximum area of the land plot; the minimum setback from the boundaries of the plot; the minimum percentage of planting; the principal finishing materials, the filling of openings, canopies; the spatial-volumetric and compositional-silhouette characteristics, including the configuration and the pitch of the roof;
e) requirements for the architectural solutions of capital construction objects and for the external appearance of individual housing construction;
f) requirements for the architectural and urban-planning appearance;
g) requirements for the placement of information structures, advertising, signs and outdoor lighting, and of parking; for colour schemes; for the character of fences, surfaces and small forms; for the placement of engineering equipment.
D.8.3 The requirements are differentiated by the zones and morphotypes distinguished on the reference plan. A single set of parameters for the whole territory of the historic settlement is permitted only for a compact settlement with a homogeneous environment. For a historic settlement with several historic districts a single set is not sufficient.
D.8.4 The requirements for urban-planning regulations secure the preservation of the subject of protection and are not used to fill the gaps of an imprecise subject of protection. If an element of value is not described in the subject of protection, it is recommended that it be described in the subject of protection, and not "closed" by a prohibition in the regulation.
D.8.5 The requirements for the urban-planning regulations of the historic settlement are taken into account in the land-use and development rules. The Urban Planning Code of the Russian Federation [3] operates with types of permitted use, limit sizes of plots, limit parameters of permitted construction and constraints established in accordance with the legislation. The requirements of the documentation of the historic settlement, including the requirements for the architectural and urban-planning appearance, are formulated so that they can be unambiguously translated into those parameters without loss of the meaning of protection and can be unambiguously perceived as part of urban-planning plans of land plots. In mode A the land-use and development rules in respect of the territory of the historic settlement are brought into conformity with the master plan. The draft land-use and development rules are agreed with the cultural heritage protection authority (paragraphs 5–7 of Article 60 of Federal Law No. 73-FZ [1]). The types of permitted use of land plots are established in accordance with the Land Code of the Russian Federation [2].
D.8.6 It is recommended that the layering of the requirements of the documentation of the historic settlement and of the requirements of the drafts of the protection zones of cultural heritage objects be excluded in respect of mutually contradictory parameters for one and the same land plot. Where the subject of regulation coincides, it is recommended that the stricter norm necessary for the preservation of the corresponding elements of the subject of protection be applied; for the protection zones of different cultural heritage objects such a rule is established by paragraph 34 of the Regulations on protection zones of cultural heritage objects, approved by Resolution of the Government of the Russian Federation No. 972 of 12 September 2015 [9].
D.8.7 The effect of urban-planning regulations within the boundaries of the territory of the historic settlement does not extend to land plots within the boundaries of the territories of monuments and ensembles in the cases established by the legislation on cultural heritage objects. For such plots the regimes of maintenance established in respect of the cultural heritage object are applied.
D.8.8 It is recommended that the requirements be checked for risks: a tourism single function; displacement of residents; the impossibility of technological connection and of servicing the built fabric; the loss of historically valuable town-forming objects as a result of an emergency condition in the absence of a preservation regime. It is recommended that the risks identified be removed by a combination of the regulation, development programmes, the implementation plan and social protection measures, and not by a tightening of prohibitions. The implementation plan of the sustainable development documentation does not replace the requirements for urban-planning regulations.
D.8.9 Model architectural solutions are developed on the basis of the morphotypes of the reference plan. A model solution does not replace the subject of protection and is not a ground for imitation of the historic environment where authenticity has been lost.
D.9 Recommended procedure of development and application
D.9.1 It is recommended that the documentation of the historic settlement be developed in parallel with the sustainable development documentation, and not as a completed protection act after which the sustainable development documentation begins. The establishment of constraints before the development of the development model is not recommended. The absence of sustainable development documentation does not prevent the establishment of the boundaries, of the subject of protection and of the requirements for urban-planning regulations (D.1.3). After approval, those acts are applied in the implementation of sustainable development documentation. In mode A it is recommended that the time frames of the stages of D.9.2, items e)–h), be synchronized with the time frames of the preparation of the master plan.
D.9.2 The recommended sequence of the work is:
a) an express analysis of the territory and recording of the degree of formalization of the status (5.1.2, 5.1.5);
b) the assignment for the studies and for the collection of source data (5.8, Clause 6);

Items k)–n) are not included in the package sent for approval under Order of the Ministry of Culture of the Russian Federation No. 1604 of 12 July 2016 [7], and do not duplicate the procedures of Clauses 10–12.
D.9.3 It is recommended that stages e)–h) be carried out iteratively in joint development. A refinement of the subject of protection may entail a change in the boundary and in the regulations. A refinement of the development model of the sustainable development documentation may recommend a change in the regulations and, where necessary, in the boundary. A decision to amend an approved act is taken in the procedure established by the legislation on cultural heritage objects. The iterations are documented.
D.9.4 For a historic settlement of federal significance the package is sent to the Ministry of Culture of the Russian Federation in the composition established by paragraph 3 of the Procedure approved by the Order of 12 July 2016 No. 1604 [7]. For a historic settlement of regional significance the package is formed under the law of the subject of the Russian Federation, with this Annex applied to the extent that it does not contradict that law.
D.9.5 After approval, the documentation of the historic settlement is placed in the federal state information system for territorial planning. It is recommended that the geographic information layers of the reference plan be transferred to the information system of the territory (6.9, Annex C) and kept current for the implementation of sustainable development documentation. In mode A this information is used in the spatial data of the master plan (6.9.1, Annex C, C.10).
D.9.6 Updating of the documentation of the historic settlement is recommended when the condition of the elements of the subject of protection changes, when new value characteristics are identified, when the socio-economic model changes so as to make the previous constraints unrealizable, and on the basis of the results of monitoring (12.5.6, 12.9.2). Updating is not an automatic consequence of monitoring and is carried out in the procedure established for the corresponding category of historic settlement.
